on the 25th July 2012, my girlfriend received a text from +1 (917) 769-7054 which stated the following “ Congratulations, you are Apple’s Winner of the day! Go to http://www.apple.com.au.winatxt.com and on last page enter code : 2399 to claim your FREE prize.



She followed the link which lead her to Ziinga.com , and she won an ipod shuffle for $7:34Au. She read the initial terms and conditions To which nowhere it states that she has to pay a subscription $89.99 per month.



Upon entering her details, and believing that the terms and conditions were those that she had read, she submitted enter, and received an email which congratulated her on her purchase, and then at the bottom of the page, it stated that membership will cost $89.99au a month.



Not only has she been completely mislead, but when I spoke to them, they did not seem to care that they had not informed us of this until the last minute.


I immediately requested that they cease our contract for misleading us into it, but they said they will stick by their terms and conditions.


They have completely mislead her into this contract and she wants out, as stated, I have already submitted the complaint to ziinga.com but to no avail.

Furthermore, I have attached a link in which the Advertising Standards Authority critiscised the website for doing this exact thing in the U.K . yet they are still doing it in Australia.

With that information at hand, this just proves that i too was mislead into a contract by being enticed with "FREE" Goods.

I have complained to the Office of Fair Trade in the U.K upon advice from the Australian Consumer watchdog, and have an email typed up outlining why the contract needs to be rescinded.

Yet they are still adamnant that she is locked into the contract
