Reason: Per a signed contract I was to receive $134,500 by August 6, 2012.

I have a signed contract written by Platinum Resort Services which clearly states that I would receive $134, 500 within 180 days of signing, as stated within the Escrow Liquidation Contract, Item 6. Item 7 of the same contract clearly states, `The full execution of this contract must take place within 180 days of the full execution of this contract.'


On August 30, 2012 I received the following email from Platinum Resort Services:

Good Morning Mr. and Mrs. Dark,

First of all thank you for your patience in getting back to you. My name
is Leslie Watson with customer service we have a few staff members on
vacations and I was also waiting for a status update on your property so
again your patience is appreciated. Everything is going great and we have
been informed that the verification of the recorded condominium regime
completed and title search (conveyance of property) finalized. Currently we
are still waiting for the lien certificate (certificado de libertad de
gravamen --in Spanish) to be finalized and in turn notarized (this usually
takes between 20 and 50 days). Mexican property commonly have some twists,

can get back to you as fast as possible. Again thank you for checking in and
have a great day and a great upcoming Labor Day.

*Through the dates of August 26th through to September 8th we will not have
a secretary to answer incoming calls. We apologize for this inconvenience
and starting September 9th we will be back to regular office hours. Thank
you for your understanding in this matter and have a great day.

On October 26, 2012 I again received an email from Platinum Resorts Services:

Good Afternoon Mr. Dark,

Thank you for your -mail. Customer service has been giving a hand with customer inquiries as I have been on resort inspections. I have checked the system on your Grand Luxxe membership transfer and we are still showing the certificado de libertad de gravamen (lien certificate) is still not in. They did go through some holidays in Mexico and they do require 20 to 50 working days to have this completed so things should be finishing up as soon. Estimated time is the last half of November but we are pushing to get this completed faster. Thank you for your understanding in this matter Mr. and Mrs. Dark and have a great weekend.

On December 12, 2012 an email from Pam Reynolds states, 'I have checked with the resale department and they informed me that the Lien Certificate was received last week and that your file is in the legal department being reviewed along with the buyer's information.'

On January 6, 2013 I sent them an email stating, 'Please take further Notice that I am now forced to charge your company a monthly late fee of 8% annually on the $134,500 that should have been paid by August 8, 2012. These charges will begin from August, 2012. As of January 6, 2013 Platinum Resorts Services current late fee charges are $4,543.51 , thus bring the total currently owed to me to $139,043.51.'

The reply to this from Pam Reynolds on January 9, 2013 was: 'What I will do is check with the legal department on the information that you have given me and when I receive a response I will definitely get back with you.'

Platinum Resort Services has not met with the conditions they set forth in the contract my wife and I signed.
