Re: “Marriages and Divorces” in Mexico.

Marriages in Mexico between foreigners require x rays, blood tests, four witnesses and must be validated. They did not have any of these. Please see section attached on “Foreigners Getting Married To Foreigners.”

I have searched for records in the Mormon Library online and have spoken to them.
(Case 23179 Mormon Library). There are NO RECORDS (amongst 3 billion) from Tia Juana, Mexico at the Mormon library. Bottom line, it’s big business.

Illegal marriages in Mexico are rampant and attorneys in both states are making money attempting to find them and cannot since none are registered. The illiteracy rate in Mexico in 1971 was 90%. Documents are all in Spanish yet Forged Docs are
Notarized so innocent Americans don’t even know what’s written on them.

This marriage was never “legalized” and lasted less than a year resulting in no children. Walter D Newman died June 1 2007. Neither lived in Mexico.

Divorce in Mexico is even harder. Please see page 2 on “Residence Requirements,” a law that took place March 7, 1971. Their marriage took place July 3, 1971 and the divorce was March 1, 1978. The divorce was “mail order” for $125.00. Divorces in Mexico cost thousands not hundreds. It requires that an alien be a resident of Mexico before one can apply for a Mexican divorce. He must obtain a certificate from the Secretaria de Gobernacion stating that he has legal residence in Mexico. Please see attached.
A legal Mexican marriage must be registered in the State you live to be legal. This never happened and there is no record on Ancestry.com

5. SSR 66-1 Section 202 (b) Term of Marriage Purpoted by foreign divorce
“Under the general principals of law as applied by States of the U.S., the
domicile of one party within the jurisdiction granting the divorce is required for
a divorce to be valid, and a divorce granted in a jurisdiction in which neither party is
domiciled is not recognized by courts of Mexican States……” That is because you
must live in Mexico to get a divorce. Their “mail order” in 1978 was from the US
Neither Walter nor Estelle ever lived in Mexico.

In Summary
Mexican Marriage and Divorce Records not recognized by our courts. The Newman marriage was a 15 min. $50 Marriage behind a shower curtain, lasted a year with no children. A Real “Civil Registry” marriage took 48 hours to make an appt. in 1971. This was verified by a Tijuana Attorney (from the Consulate here) via email and my cousin, Angelica, married legally in Tijuana 11-10-73.

Furthermore, the federal cases used tax returns, living together & having children
as the more powerful testimony for granting of pensions. Also, Estelle has no history of working 40 quarters, has worked all her life for Gerald and would be devastated if she did not receive his pension. Walter Newman also has addresses on Ancestry.com and has never domiciled in Mexico. He remarried 10/78, died 6/07 and we are in touch with his widow Mica.

Here is additional proof of residences of Estelle C. Newman Kenney and births of her children with Gerald. Also, according to Civil Code in CA 1276 (??) circa 1976 “Anyone can change their name as long as it is not for deception or fraud.” We were all ashamed of our Mexican Heritage name Lopez.
