Evolutions Bank Card and Commerce Payment

Tom Smith, from Evolutions Bank Card, contacted me and offered lower rates for credit card services. He said there will no monthly fees, no hidden charges, and a free terminal. He guaranteed that Evolutions Bank Card is the #1 merchant services company, and I will be happy with the rates that I'll be getting. Lies. I sent back the terminal that was never even used or set up. I demanded a return UPS shipping label, and mailed it back.
I check my checking account on a daily basis. I saw an unauthorized charge on my account, and immediately did some investigation. Evolutions Bank Card charged me $65 for a monthly insurance fee and setup fee. I contacted my bank and requested to put a stop payment.
When I contacted Evolutions, they told me I needed to call Commerce Payment. All customer services are aware that customers are being scammed, and they gave me the run-around and will not transfer me to a manager. A female customer service was kind enough to tell me the honest truth, that I will not be receiving my money back, and my request was denied. She said that i signed a contract, therefore, they will not credit me.
I will continue to email/call this TOM SMITH, sales agent, UNTIL he resolves this issue. I have proof in emails that he said there will no monthly fees, hidden fees, what-so-ever.
This is fraud, attacking new business owners, and they deserve to be sued and shut down.
