On 12/27/2010, I received a call on my cell phone from Aaron Snyder (with a strong Hindu accent, not the German one would expect from that name) w/ Asset Acceptance, telling me they were collecting on a debt that was incurred in 1999. They had my current mailing address, current name, as well as what sounded like legitimate information for this account. Unfortunately, not only do I not remember ever incurring the debt they were calling about, but after 11 years and 5 moves, even if it were mine there would be no proof left. When I stated unequivocally that this wasn't mine, they hadn't satisfactorily proved who they were, and that I wasn't paying a single red cent, I was informed that I needed to file a complaint with their fraud dept, including the police report where I reported the fraud, in order to prove that this wasn't my debt. They had no answer for my questions as to why this wasn't on my credit report and hadn't been since at least 2005, when I closed on my house; why I was just hearing about this 6 years after cleaning up my report and 11 years after they said the debt was first reported; how they got my information in conjunction with this account. After hanging up, I checked them out on the BBB: A+ rating, over 800 complaints in a 12-month period, and out of those, over 500 had been closed by BBB for no action taken.

Needless to say, not only is Asset Acceptance in the business of trying to scam people out of money in the guise of collecting on debts; if they want you to pay on something you don't remember or have records of, burden of proof should be on them. How on earth do they expect me to prove a negative?
